The laws governing medical malpractice claims vary from state to state. In North Carolina, there has been a consistent and disturbing trend toward legislative implementation of laws that protect the interests of the health care providers, while restricting the rights of the patients who are victims of medical negligence. These laws deny justice to North Carolina citizens. When the negligent actions of a health care provider cause serious harm or death, just compensation should be paid to the victim of those actions.
Virtually all health care providers have insurance to cover them in situations when their negligent care results in serious injury or death. Unfortunately, the companies that insure these health care providers aggressively defend against patients’ claims for compensation. In North Carolina, these insurance companies have been highly successful in hiring powerful lobbyists and using other means to influence the State Legislature to pass the laws that unfairly favor the interests of hospitals, doctors, and other providers over the interests of negligently injured patients. Moreover, these laws have made it so expensive and difficult to file and pursue a medical negligence lawsuit that more and more attorneys are unwilling to take on such cases on behalf of injured patients.
